Shifting burdens

Depending on the type of proceeding, the burden of proving something could shift between the plaintiff and defendant or defendant and prosecution. Sometimes the statute that allows for the civil cause of action or creates the criminal liability will dictate upon which party the burden sits. Sometimes, one must look to the common law to make this determination.

This project is concerned with exploring how we might create a system that can look at a civil complaint and determine upon whom the burden of proof would rest.
